Terms of Use (Terms of Service) — Stocks and Options Alerts

Last updated: October 12, 2026 · Terms version: 2026-10-10.2

These Terms of Use, also called our Terms of Service ("Terms"), are a binding agreement between you and Mohammed N. Noor, doing business as Stocks and Options Alerts ("Stocks and Options Alerts," "we," "us," or "our") covering your use of the Stocks and Options Alerts mobile and desktop apps, the website stocksandoptionsalerts.com, push notifications, and all related content and services (together, the "Service").

PLEASE READ SECTION 15 CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL BINDING ARBITRATION, WAIVES YOUR RIGHT TO A JURY TRIAL AND TO TAKE PART IN A CLASS ACTION, AND EXPLAINS HOW TO OPT OUT WITHIN 30 DAYS.

By checking the box to accept these Terms and our Privacy Policy, creating an account, starting a free trial, subscribing, or otherwise using the Service, you agree to these Terms and to our Risk Disclaimer (stocksandoptionsalerts.com/disclaimer) and Privacy Policy (stocksandoptionsalerts.com/privacy), which are part of these Terms. If you do not agree, do not use the Service — close and uninstall the app and cancel any subscription in your App Store or Google Play settings (deleting the app does not cancel a subscription).

1. Eligibility

You must be at least 18 years old (or the age of majority where you live, if higher) and able to form a binding contract to use the Service. The Service is intended for users in the United States. By using it you confirm that you meet these requirements.

2. What the Service is — information only, not advice

2.1 General information. The Service is an automated market-information and alert tool. It publishes general, impersonal market information — for example, price levels, volume activity, alert entry/target/stop reference levels, and the later outcome of each alert — for educational and informational purposes only.

2.2 Not investment advice. Nothing in the Service is investment, financial, legal, accounting, tax, or trading advice, or a recommendation, solicitation, endorsement, or offer to buy, sell, or hold any security, option, or other financial instrument, or to follow any trading strategy. Specific alerts, setups, and strategies are illustrative examples of market conditions. Terms such as "entry," "target," "stop," "setup," or "score" describe the reference levels and status of an alert; they are not instructions to trade.

2.2A No advice from anyone at Stocks and Options Alerts. Neither Stocks and Options Alerts nor its owner, employees, contractors, or support staff gives personalized advice of any kind. Replies to support emails, comments or posts on social media, videos, and any other communication from us are general information only and do not create an advisory relationship.

2.3 Not personalized. Alerts and content are the same for every user who has selected the same alert types. They are not tailored to your financial situation, investment objectives, risk tolerance, account size, or portfolio. We do not know your circumstances, and we do not consider them. Choosing which alert types you receive is a display filter only.

2.4 Not a registered adviser or broker. We are not registered as an investment adviser with the U.S. Securities and Exchange Commission or any state, and we are not a broker-dealer, futures commission merchant, commodity trading advisor, or financial planner. No fiduciary, advisory, or client relationship is created by your use of the Service, by paying for it, or by communicating with us.

2.5 Consult a professional. Before making any investment decision — especially before trading options — you should do your own research and consult a licensed financial professional, and a tax or legal adviser where appropriate, who knows your situation.

3. No brokerage services; you make your own trades

The Service does not open brokerage accounts, hold your money or securities, connect to your brokerage account, or place, route, or execute trades for you. Any trade you make is made by you, independently, through a broker you choose, at your sole discretion and risk. You are solely responsible for your own decisions, order types, position sizes, and timing, and you use the Service and any information in it at your own risk.

4. Assumption of risk

4.1 Trading stocks and options involves substantial risk of loss and is not suitable for everyone. You can lose some or all of the money you invest. Only trade with money you can afford to lose.

4.2 Options-specific risk. Options are complex, leveraged instruments. Buyers of options can lose their entire premium; options can expire worthless; and same-day and short-dated options (including "0DTE" options) can lose most or all of their value within minutes. Sellers of options may face losses greater than the amount received, including theoretically unlimited losses. Before trading options you should read Characteristics and Risks of Standardized Options (the Options Disclosure Document), available from your broker or the Options Clearing Corporation.

4.3 Fast-moving markets, gaps, halts, low liquidity, wide bid/ask spreads, and after-hours trading can cause fills far from any level shown in an alert.

4.4 You accept full responsibility for any gains or losses that result from any trade you choose to make, whether or not it relates to an alert.

5. No guarantee; past and hypothetical performance

5.1 We do not guarantee any result, profit, win rate, or level of accuracy. Past performance — including the outcomes of past alerts — does not guarantee or predict future results.

5.2 How results are shown. Any results, percentages, "peak gain," "closed," win/loss, or track-record figures shown in the app, on our website, or in our marketing are alert outcomes: they are calculated from the reference prices in the alert and later market quotes. They are hypothetical and are not the actual trading results of any user. They do not reflect commissions, fees, taxes, slippage, bid/ask spreads, partial fills, or the price you could actually have traded at, and they may be calculated using last-trade, mid, or mark prices. Hypothetical results have inherent limitations, including the benefit of hindsight. Your results will differ and may be worse.

5.3 We aim to keep every closed alert on record, including losing alerts. Where marketing highlights particular alerts (for example, a single closed trade in a video), that is a selected example and is not representative of all alerts.

6. Data accuracy, delays, and availability

6.1 Market data, quotes, charts, news, calendars, and alerts come in part from third parties and are provided "AS IS" and "AS AVAILABLE." They may be delayed, incomplete, inaccurate, or interrupted.

6.2 Push notifications depend on your device, operating system, network, and third-party delivery services. Alerts may arrive late, out of order, more than once, or not at all. Alert reference levels and outcomes may be revised or corrected after they are first shown.

6.3 We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. We are not liable for any trading loss, missed opportunity, or other damage resulting from delayed, inaccurate, incomplete, or failed data or notifications. Do not rely on the Service as your only source of information.

7. Conflicts of interest; our own trading

Stocks and Options Alerts, its owner, and affiliates may hold, buy, or sell positions in the securities or options mentioned in alerts or other content, including before, at the same time as, or after an alert is published, and may trade in a way that differs from an alert. Positions and outcomes shown in the Service are not a representation of any particular person's account.

8. Subscriptions, free trial, billing, and cancellation

8.1 Purchases through the app stores. Paid plans ("Pro") are sold through Apple's App Store or Google Play (each a "Store"). Your purchase is processed and billed by the Store under its terms. Prices are shown in the app before purchase and may vary by region and change over time.

8.2 Free trial. New users receive a free trial (currently 30 days) that starts when you first open the app and requires no payment. When it ends, Pro features stop unless you choose a paid plan; you are charged only when you subscribe.

8.3 Auto-renewal. Monthly and yearly subscriptions automatically renew at the then-current price for the same period unless you cancel at least 24 hours before the end of the current period. You authorize the Store to charge your payment method for each renewal.

8.4 How to cancel. Cancel in your device's subscription settings: on iPhone/iPad/Mac, Settings → your name → Subscriptions; on Android, Google Play → Payments & subscriptions → Subscriptions. Deleting the app does not cancel a subscription. After cancellation you keep access until the end of the paid period.

8.5 Lifetime plan. A "Lifetime" purchase is a one-time payment for access to Pro features for as long as we offer and operate the Service for that app; it does not auto-renew. It is not a guarantee that the Service will be offered forever.

8.6 Refunds. All purchases are made through Apple or Google, and refunds are handled solely by Apple or Google under their own refund policies. We cannot issue, approve, or process refunds for App Store or Google Play purchases. To request a refund, use Apple's "Report a Problem" (reportaproblem.apple.com) or Google Play's order history / refund request. Except where required by law, we do not provide refunds or credits for partial periods.

8.7 Price changes. We may change prices or plan features. The Stores notify you of price increases as their rules require, and you may cancel before the new price takes effect.

9. Referral program

If we offer a referral program, rewards (for example, free Pro time) are subject to the program rules shown in the app at the time, have no cash value, cannot be transferred or sold, and may be limited per user. We may withhold rewards for fraud, self-referrals, duplicate or fake accounts, or abuse, and may change or end the program at any time. Rewards may be delivered as Store offer codes or promotional access where Store rules require.

10. Your license and acceptable use

10.1 We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial purposes, subject to these Terms and to the Store's terms (including Apple's Licensed Application End User License Agreement, where it applies).

10.2 You agree not to: (a) copy, resell, redistribute, repost, publish, re-broadcast, screenshot for distribution, or otherwise share alerts or other content — including in Discord or Telegram servers or channels, WhatsApp or other group chats, paid groups, or on social media — without our prior written permission; (b) share your account or subscription; (c) scrape, data-mine, or use bots to access the Service; (d) reverse engineer, decompile, or attempt to discover source code, data sources, or methods, except where the law allows; (e) interfere with or overload the Service, or bypass security or payment controls; (f) use the Service to break any law or to manipulate any market; or (g) misrepresent our alerts or results to others.

10.3 We may suspend or terminate your access to the Service, without refund from us, if you break these Terms — including the no-redistribution rule in 10.2(a) — with or without notice, to the extent the law allows. We may also pursue any other remedies available to us.

11. Intellectual property

The Service, including its software, design, text, alerts, graphics, logos, and the name "Stocks and Options Alerts," belongs to us or our licensors and is protected by law. These Terms do not give you any ownership rights. If you send us feedback, we may use it without obligation to you.

12. Third-party services and links

The Service relies on and may link to third-party services (for example, the App Store, Google Play, notification services, market data and news providers, analytics, and social platforms). We do not control and are not responsible for third-party services, content, or terms, and your use of them is at your own risk. Apple and Google are not parties to these Terms and are not responsible for the Service, except as stated in their own terms.

13. Disclaimer of warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND TIMELINESS. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.

14. Limitation of liability

14.1 TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, LOST OPPORTUNITIES, OR LOSS OF DATA, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

14.2 TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $50.

14.3 These limits apply to all theories of liability and even if a remedy fails of its essential purpose. Some jurisdictions do not allow these limits, so they may not fully apply to you. Nothing in these Terms limits liability that cannot be limited by law, or waives any non-waivable right you may have under federal or state securities laws.

15. Dispute resolution: binding individual arbitration and class action waiver

15.1 Informal resolution first. Before starting arbitration, you agree to email [email protected] with your name, a description of the dispute, and the relief you want, and to try in good faith to resolve it for 30 days.

15.2 Agreement to arbitrate. Except as stated in 15.5 and 15.6, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by final and binding individual arbitration, not in court. The Federal Arbitration Act governs this Section.

15.3 Rules and location. Arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules (adr.org) then in effect, before a single arbitrator. Fees will be allocated as those rules provide. The arbitration may be held by video, phone, or written submissions, or, if an in-person hearing is held, in the State of New York, unless the AAA Consumer Arbitration Rules require a different location or you and we agree on another place. The arbitrator may award any individual relief available in court, but only to the individual party and only to the extent needed for that party's individual claim.

15.4 Class action and jury trial waiver. YOU AND WE EACH AGREE THAT DISPUTES WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING OR CLASS-WIDE ARBITRATION. YOU AND WE EACH WAIVE THE RIGHT TO A JURY TRIAL. If this class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) will be severed and decided in court, and the rest of this Section still applies.

15.5 Small claims. Either party may bring an individual claim in a small claims court where you live or in the State of New York if the claim qualifies, instead of arbitration.

15.6 Intellectual property and injunctive relief. Either party may go to court to stop infringement or misuse of intellectual property or unauthorized access to the Service.

15.7 30-day opt-out. You may opt out of this arbitration agreement by emailing [email protected] with the subject "Arbitration Opt-Out," your name, and the email or device/app user ID you use with the Service, within 30 days after you first accept these Terms. Opting out does not affect any other part of these Terms.

15.8 Changes to this Section. If we make a material change to this Section, it will not apply to a Dispute you already notified us about, and you may reject the change by emailing us within 30 days after it takes effect.

16. Governing law and venue

These Terms are governed by the laws of the State of New York and applicable U.S. federal law, without regard to conflict-of-laws rules. For any Dispute not subject to arbitration, you and we agree to the exclusive jurisdiction of the state or federal courts located in the State of New York, except that you may bring a small-claims action where you live.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Stocks and Options Alerts and its owners and agents from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service, your violation of these Terms, or your violation of any law or third-party right. This does not apply to the extent a claim is caused by our own misconduct.

18. Changes to the Service and these Terms

We may modify, update, or replace these Terms, and may modify, suspend, or discontinue any part of the Service, at any time, with or without notice. Changes take effect when posted, and the "Last updated" date above will change. Your continued use of the Service after changes are posted means you accept them. For material changes we may, but are not required to, notify you in the app or ask you to accept the updated Terms. If you do not agree to a change, stop using the Service and cancel your subscription. Changes to Section 15 (Dispute resolution) are also subject to Section 15.8.

19. Apple-specific terms

If you downloaded the app from Apple's App Store: these Terms are between you and us, not Apple; Apple has no obligation to provide maintenance or support; to the extent any warranty applies and the app fails to conform, you may notify Apple for a refund of the purchase price (if any), and Apple has no other warranty obligation; Apple is not responsible for addressing claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims; Apple is not responsible for third-party intellectual-property claims; you represent that you are not in a U.S.-embargoed country or on a U.S. government restricted-party list; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. General

These Terms (with the Risk Disclaimer and Privacy Policy) are the entire agreement between you and us about the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, sale, or transfer of the Service. Sections that by their nature should survive termination (including Sections 2–7 and 11–20) survive.
